The California Attorney Generals Office is a branch of the California Department of Justice, the attorneys who represent the interests of the state in California state judicial proceedings. The licensing section of the Attorney Generals Office handles professional licensing denials and revocations, through the filing of Statements of Issues for license denials and Accusations against licensed professionals facing discipline. The individual attorneys who handle licensing cases are Deputy Attorney Generals , supervised by Supervising Deputy Attorney Generals , and they work in four main offices throughout California: Los Angeles, San Diego, Oakland, and Sacramento.
Most state agencies are represented by DAGs during disciplinary proceedings. At the investigation stage, the Deputy Attorney General works with an investigator and an expert to discuss the probable disciplinary proceedings that follow the investigation. When the case reached the Accusation stage, the Deputy Attorney General writes the Accusation and then deals with correspondence with the licensee, including discovery, scheduling, evidence, and possible settlement. If the case is not resolved prior to trial, the DAG prosecutes the agencys position in the administrative hearing in front of the Administrative Law Judge at the Office of Administrative Hearings.
Death Penalty And Cash Bail Reconsidered
Unlike Hochman, Bonta has a lengthy political record as a legislator. And its a telling one.
In 2018, he co-authored a bill to ban county courts from setting cash bail for people awaiting trial, insteading leaving the decision about whether a person should go free or not to a judge using risk-assessment tools. That bill was signed into law. But voters nixed that idea in a 2020 referendum funded by the bail bond industry.
That public rebuke hasnt changed Bontas mind. He argued that voters may have been wary of the risk-assessment system that would have replaced the current system, which he acknowledged was not perfect.
But cash bail, he insisted, remains unpopular and manifestly unfair.
I believe that the current bail system punishes poor people for being poor, makes the jailhouse door swing open and closed based on how much money you have in your pocket, and judges you based on the size of your wallet, instead of the size of your risk, he said.
While in the Assembly, Bonta also supported a proposed constitutional amendment to officially end the death penalty in California. Thats despite the fact that California voters have repeatedly turned down that opportunity, including as recently as 2016. California hasnt executed a prisoner since 2006, and in 2019, Newsom declared a moratorium on the practice.
Laws Requiring Service On The Attorney General
Data Security Breach: Civil Codes s. 1798.29 and s. 1798.82 – California law requires a business or state agency to notify any California resident whose unencrypted personal information, as defined, was acquired, or reasonably believed to have been acquired, by an unauthorized person. As of January 1, 2012, this law now requires a business or state agency to send an electronic sample of the breach notification sent to California residents, if the breach affected more than 500 residents. The sample should exclude any personally identifiable personal information.

Attorney General Josh Shapiro Announces Settlement With Walmart Over Opioid Epidemic Allegations
Walmart to pay an estimated $120 million to fund treatment resources in Pennsylvania
HARRISBURG Attorney General Josh Shapiro today announced that he has reached a settlement with Walmart to resolve allegations that the company contributed to the opioid addiction crisis by failing to appropriately oversee the dispensing of opioids at its stores. As part of the settlement, Walmart will pay more than $3 billion nationally, with Pennsylvania to receive an estimated $120 million, to help fund treatment resources in impacted communities. In addition, Walmart has agreed to make significant improvements in how their pharmacies handle opioids. State attorneys general on the executive committee, attorneys representing local governments, and Walmart have agreed to this settlement, and it is now being sent to other states for review and approval. Pennsylvania is estimated to receive $120 million from this settlement.
Too many families have lost loved ones to the opioid epidemic, and too many people have lost years of their lives to addiction, said AG Josh Shapiro. My office is determined to hold accountable the companies that created and fueled this crisis. Companies like Walmart need to step up and help by ensuring Pennsylvanians get the treatment and recovery resources they need. This deal with Walmart adds to the important progress weve already achieved through our settlements with the opioid manufacturers and distributors and were not done yet.

DOJ finds manufacturer Sky Tactical Supply wrongly claimed its FIFY rifle attachment allows buyers to evade Californias assault weapon laws
OAKLAND California Attorney General Rob Bonta today ordered an immediate stop to the marketing, sale, and distribution of a device advertised as a way for gun owners to evade Californias assault weapon laws. The Fixed It For You Fixed Magazine Cage is a metal device that is installed with a five-round magazine into the pistol grip of a rifle, but the magazine is not actually involved in the loading, firing, and unloading of the rifle. FIFYs manufacturer, Sky Tactical Supply, has been marketing the FIFY with incorrect claims that installing it would exempt a rifle from Californias definition of an assault weapon. Today, the Attorney General sent a cease-and-desist letter to Sky Tactical Supply, warning the company that it is potentially committing criminal offenses by selling the FIFY in California, and is misleading California consumers about their criminal liability if they buy the product. The Attorney General also issued a bulletin to all criminal justice and law enforcement agencies, firearms dealers, firearm manufacturers, and exempt federal firearms licensees in the state, advising them that firearms with a FIFY and five-round magazine are not exempt from Californias assault weapon laws.

Attorney General Rob Bonta
On April 23, 2021, Rob Bonta was sworn in as the 34th Attorney General of the State of California, the first person of Filipino descent and the second Asian-American to occupy the position.
Attorney General Bonta’s passion for justice and fairness was instilled in him by his parents, who served on the frontlines of some of America’s most important social justice movements. Instilling in him the lessons they learned from the United Farm Workers and the civil rights movement, Attorney General Bonta’s parents lit a fire inside him to fight against injustice to stand up for those who are taken advantage of or harmed. It’s why he decided to become a lawyer to help right historic wrongs and fight for people who have been harmed. He worked his way through college and graduated with honors from Yale University and attended Yale Law School.
Prior to serving in the Assembly, Attorney General Bonta worked as a Deputy City Attorney for the City and County of San Francisco, where he represented the City and County and its employees, and fought to protect Californians from exploitation and racial profiling.
Born in Quezon City, Philippines, Attorney General Bonta immigrated to California with his family as an infant. The attorney general of California is the state attorney general of the Government of California. The officer’s duty is to ensure that “the laws of the state are uniformly and adequately enforced” . The California attorney general carries out the responsibilities of the office through the California Department of Justice. The department employs over 1,100 attorneys and 3,700 non-attorney employees.
The California attorney general is elected to a four-year term, with a maximum of two terms. The election is held at the same statewide election as the governor, lieutenant governor, controller, secretary of state, treasurer, superintendent of public instruction, and insurance commissioner. A few individual attorneys general have gone on to higher offices on the state and federal level, including the offices of governor, United States Senator, chief justice of the United States Supreme Court, and vice president of the United States.
On March 24, 2021, Governor Gavin Newsom announced that he would be appointing Rob Bonta as attorney general to succeed Xavier Becerra, who resigned the position to become Secretary of Health and Human Services under President Joe Biden. Bonta’s appointment was subject to confirmation by both houses of the California State Legislature, and he was sworn in on April 23, 2021.

Electronic Service Of Summons/complaints During Covid
The Coronavirus continues to pose an unprecedented health and safety threat to the public. Because of the risks presented by the COVID-19 pandemic, the Attorney General will accept electronic service of summons/complaints when the named party is the Attorney General or the Department of Justice.
Unless this policy is amended to state otherwise, it will stay in effect through 90 days after the Governor declares that the state of emergency related to the COVID-19 pandemic is lifted.
The Attorney General reserves the right to reject service of process in civil actions where a defect in service is found. Absent express written consent to the contrary , electronic service of summons/complaints in civil actions must be made at: .
Unless otherwise agreed to in writing , the Attorney General does not agree to accept same-day service for electronic service that is made after 5:00 p.m. The Attorney General will instead construe such service to have occurred the next business day at 9:00 a.m.

Playing A Dangerous Game But Responsibly
Last year, before the U.S. Supreme Court ended the federal constitional right to an abortion entirely in June, Texas lawmakers came up with a clever way to effectively ban most abortions in the state.
Rather than have law enforcement enforce the restriction on ending a pregnancy after six weeks, a state law gave individual Texans the right to sue health care providers, patients or anyone who aided and abetted an abortion, with the potential promise of a $10,000 bounty per violation. Because the state wasnt enforcing the policy, the law was harder to challenge in court.
After the Supreme Court let the Texas law stand, Newsom clapped back, proposing a similarly structured bounty bill aimed at those who violate certain California gun laws. Bonta, whose office vociferously opposed the Texas law, helped craft the California version and was one of its most vocal public champions.
Bonta insisted that the law is an earnest effort to save lives, but also acknowledged that it was meant to call the high courts bluff.
