Desperate migrants are still lining up overnight outside New York Citys ICE headquarters in wintry temperatures only to be turned away by security guards because the backlogged agency has already reached its apparent daily quota to process them.
If you want ICE, you have to come very early in the morning like 3 in the morning. After 500 people, they are finished, a security guard told The Post outside 26 Federal Plaza in Lower Manhattan on Monday.
Asylum seekers were still facing chaotic scenes outside the immigration offices Monday even after The Post reported last week on the capricious processing issues and how some migrants had even formed a makeshift mini-tent city just to get a foot in the door.
While there were no signs of the tents Monday, migrants without scheduled processing appointments were being forced to stand in a line that stretched several blocks early in the morning and were only being served on a first-come, first-served basis.
They are closed again, I have to come back again, one mom, who was carrying her small son in a blanket, told The Post before storming off.
Once the first 500 or so migrants are let through the barricades, the rest are turned away and told to repeat the same tedious process the following day, according to the security guards posted outside.
Why come early in the morning, when you can make an appointment and wait in the other line the line at 3 in the morning is all the way to Brooklyn Bridge, one guard said.

Families Spend Hours In The Cold Waiting For Ice Appointments
It was just after 2:30 a.m. on a crisp, cold New York City night. The temperature read 34 degrees, but it felt colder. It was the first truly cold day of autumn.
âItâs pretty cold, even my foot falls asleep, even I canât move my whole hand,â said Edi Kiste, who was bundled up in a line outside immigration offices in downtown Manhattan.
She spoke with NY1 as she held her two-year-old daughter, who spent the entire night outside with her.
âI bundled her up with three pants, a jacket, and like two polo shirts inside,â she said.
She said they were still cold.
On Lafayette Street, there are many strollers and children at this very early hour, all bundled up, all waiting.
One mom appeared to breastfeed her daughter on the curb.
These families are here for the long haul, bringing out cardboard boxes, backpacks and blankets to create makeshift beds.
They are choosing to spend the night on concrete.
Laura Godoi said she arrived outside 26 Federal Plaza at 7 p.m., which was 13 hours before her appointment with immigration officials.
âIt gives hypothermia,â she said, describing the wait and the cold weather.
Thereâs a reason why so many people are lining up on a cold November night with their children.
They are waiting for their appointments with U.S. Immigrations and Customs Enforcement, also known as ICE.
Many of those NY1 met said they are required to report to ICE after crossing the southern border in recent months.
âThey say you canât enter,â he said.

Following months of a rapid influx of asylum-seekers to New York City many fleeing political persecution in Venezuela, and many bused here from Texas and Arizona the inflow of people at the southern border appears to be slowing under policy changes by the Biden administration.
But with more than 21,000 new arrivals in New York since the spring, the stream of migrants seeking asylum status at New York Citys immigration courts is as heavy as it has been for months.
On Tuesday morning, hundreds of recent migrants lined up outside lower Manhattans 26 Federal Plaza, which houses the largest of New York Citys three immigration courts. Some of the migrants were there to check in with Immigration and Customs Enforcement, while others had been called for their first hearings in their deportation proceedings.
Applying for and receiving asylum is a process that can take years, and the status is only granted to those who can prove that they have reason to fear persecution because of their race, religion, nationality, political opinion or membership in a particular social group. Asylum-seekers have one year after arriving in the United States to submit their asylum application, and they have to wait another five months after submitting that application to even apply for a permit to work in the United States.

Each weekday morning before dawn, hundreds of people stand outside the main immigration courthouse in Manhattan in a line that often curves around the building.
They arrive as early as 10 p.m. the night before, with some people wrapping themselves in cardboard to brace themselves against the cold. They covet a spot inside the federal office building, most for mandatory check-ins with Immigration and Customs Enforcement.
Gabriel Acosta, from Venezuela, said he arrived at 4 a.m.

You gotta come back before 5 in the morning, OK? a guard told a group of people huddled outside in the chilly morning air. And they only take 500 people.
New York Citys already backlogged immigration system has been straining to accommodate an influx of more than 21,000 migrants since the spring, many of whom are new arrivals bused in from border states.
A recent change in federal border policy slowed the number of asylum-seekers entering the country and consequently being bused north, but it did nothing to fix a system many regard as broken. The logjam can have life-altering consequences, including missed deadlines and even deportation orders issued in absentia.
He later added that officials are evaluating all options in case the city receives another influx of migrants.

The Jacob K. Javits Federal Office Building at 26 Federal Plaza on Foley Square in the Civic Center neighborhood of Manhattan, New York City houses many federal government agencies. At over 41 stories, it is the tallest federal building in the United States. It was built in 196369 and was designed by Alfred Easton Poor and Kahn & Jacobs, with Eggers & Higgins as associate architects. A western addition, first announced on “inadvertently acquired land” in 1965, was built in 197577 and was designed by Kahn & Jacobs, The Eggers Partnership and Poor & Swanke. The building is named for Jacob K. Javits, who served as a United States Senator from New York for 24 years, from 1957 to 1981.
The building is assigned its own ZIP Code, 10278 it was one of 41 buildings in Manhattan that had their own ZIP Codes as of 2019. The building falls under the jurisdiction of the United States Federal Protective Service for any and all law enforcement and protection issues. To the east of the main building is the James L. Watson Court of International Trade Building.
